Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website webbuilderpro.org(the “Site”) and the web design and development services provided by WebBuilderPro (“WebBuilderPro”, “we”, “us”, or “our”). By using the Site or purchasing our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
1. Acceptance of Terms
These Terms form a binding agreement between you and WebBuilderPro. A separate written proposal, statement of work, or order confirmation (“Project Agreement”) may further describe a specific engagement. If a Project Agreement conflicts with these Terms, the Project Agreement controls for that engagement.
2. Our Services
We provide website design, development, and related services, including the plans described on our Site. The specific deliverables, features, and number of pages and revisions are those listed for your selected plan or in your Project Agreement.
3. Quotes & Payment
- Prices listed on the Site are in U.S. dollars and may change at any time before you place an order.
- Unless stated otherwise, plans are billed as a one-time payment due before work begins. Some engagements may require a deposit with the balance due on delivery, as set out in your Project Agreement.
- Payments are processed securely through Stripe. By submitting payment, you represent that you are authorized to use the chosen payment method.
- Work generally commences once payment (or the agreed deposit) has been received.
4. Refunds
Because our Services involve custom work and dedicated time, fees are generally non-refundable once work has begun. If you cancel before any work has started, you may be eligible for a refund less any non-recoverable costs and processing fees. Any refund arrangements specific to your engagement will be described in your Project Agreement. Nothing in this section limits rights you may have under applicable consumer-protection law.
5. Project Scope & Revisions
The scope of your project, including the number of revision rounds, is defined by your selected plan or Project Agreement. Requests that fall outside the agreed scope (“scope changes”) may require additional time and fees, which we will communicate before proceeding.
6. Client Responsibilities
To deliver your project, we rely on you to:
- Provide accurate, complete content and materials (text, images, logos, and credentials) in a timely manner;
- Confirm that you own or have the rights to all materials you provide to us;
- Review deliverables and provide feedback or approvals within the agreed timeframes;
- Maintain your own backups of any content you supply.
Delays in providing materials or feedback may extend project timelines.
7. Intellectual Property
Upon full payment, you will own the final website deliverables produced specifically for you, except for: (a) third-party components, fonts, plugins, and stock assets, which remain subject to their own licenses; and (b) our pre-existing tools, frameworks, and know-how, for which we grant you a non-exclusive license to use as part of your deliverables. Until payment is made in full, all work product remains our property. We may display non-confidential work in our portfolio unless you ask us in writing not to.
8. Third-Party Services
Your website may rely on third-party services (such as hosting, domain registrars, payment processors, analytics, and plugins). Your use of those services is governed by their own terms, and we are not responsible for their availability, performance, or policies. Any fees charged by third parties are your responsibility unless otherwise agreed.
9. Delivery & Timelines
We aim to deliver within the timeframe indicated for your plan or Project Agreement. Estimated timelines are good-faith projections, not guarantees, and may be affected by scope changes, third-party dependencies, and the timeliness of client feedback and materials.
10. Warranties & Disclaimers
We provide our Services with reasonable skill and care. Except as expressly stated, the Site and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Services will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the fullest extent permitted by law, WebBuilderPro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Site or Services. Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the specific Service giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless WebBuilderPro from any claims, damages, liabilities, and expenses arising out of your breach of these Terms, your misuse of the Services, or content and materials you provide to us, including claims that such materials infringe a third party's rights.
13. Termination
Either party may terminate an engagement as set out in the Project Agreement. We may suspend or terminate your access to the Site or Services if you breach these Terms. Upon termination, you remain responsible for fees for work performed up to the termination date, and provisions that by their nature should survive (such as intellectual property, disclaimers, and limitations of liability) will continue to apply.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which WebBuilderPro is established, without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located there for the resolution of any disputes, except where prohibited by applicable law.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
